DMCA Policy

Congressional District Primary ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. This Digital Millennium Copyright Act ("DMCA") Policy outlines our procedures for addressing alleged copyright infringement on our website and platform.

It is our policy to respond to clear notices of alleged copyright infringement that comply with the DMCA. We will promptly process and investigate notices of alleged infringement and will take appropriate actions under the DMCA and other applicable intellectual property laws.

Filing a DMCA Takedown Notice

If you believe that material available on our website or platform infringes on your copyright, please send a DMCA Takedown Notice to our Designated Copyright Agent with the following information, in writing:

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: A description of where the material that you claim is infringing is located on our website or platform, sufficient to permit us to locate the material (e.g., a URL link to the specific page or content).
  3. Your contact information: Your full legal name, mailing address, telephone number, and email address.
  4. Statement of good faith belief: A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement under penalty of perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.
  6. Electronic or physical signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Filing a DMCA Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may send a DMCA Counter-Notification to our Designated Copyright Agent. Your Counter-Notification must include the following information, in writing:

  • Identification of the removed material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  • Statement of good faith belief: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your contact information: Your full legal name, mailing address, telephone number, and email address.
  • Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for any judicial district in which Congressional District Primary may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Electronic or physical signature: Your physical or electronic signature.
